CIRCULAR DATED JANUARY 15, 1996


ON THE LAND USE PLANNING IN THE PROVINCES AND MUNICIPALITIES


THROUGHOUT THE KINGDOM OF CAMBODIA

To date, we have noticed that since
the formation of the Royal Government, the socio-economic activities,
the rehabilitation and construction of infrastructure and buildings
have been developed in a rapid way. However, the Royal Government has
observed that constructions of new infrastructures, factories, hotels,
restaurants, markets, gardens, public parks, development-zones, tourist
centers, especially housing settlements and shops were not developed
according to sound technical principles of urbanization and
construction.


To overcome such problems, the Royal Government shall hereby instruct ministries and institutions as follows:


To implement the Law on Land Use,
Urbanization and Constructions in accordance with Article 5 which read
"The Committee for the Urbanization of Phnom Penh municipality or the
Sub-committee for the Urbanization and Construction of provinces and
municipalities shall make the plan for the preparation and development
of Phnom Penh and provinces and municipalities. Such plan to be agreed
by the National Committee for the Urbanization and Construction and
shall be specified by an anukret.


To keep the national patrimony and
environment and to ensure the economic development of special areas as
specified by the Council of Ministers, the National Committee for
Urbanization and Construction shall prepare plan to be submitted to the
Council of Ministers".


To implement the Law on Land Use,
Urbanization and Constructions which was approved by the National
Assembly on May 23, 1994, the Royal Government shall delegate the
duties to the Ministry of Interior to instruct the Phnom Penh City hall
and throughout the country on the co-operation in improving the
technical component of the Committee for the Urbanization and
Construction of Phnom Penh, and the sub-committee for the Urbanization
and Construction of provinces and municipalities. They shall prepare
plan to develop their provinces and municipalities and specify the
infrastructure, road networks, commercial areas, industrial areas,
hotels, tourism centers, garages, railroad stations, airports, schools,
Buddhist monasteries, public administration areas, police areas,
military areas, environment areas, gardens, public parks, garbage
collection, sewer tanks, water pipes, electric network, land for
development, forests, wild animal refuge, lakes, rivers, sea, islands,
residential land, and land for cultivation, etc.


The Ministry of Agriculture, Forestry
and Fisheries, the Ministry of Public Works and Transports, the
Ministry of Industries, Mines and Energy, the Ministry of Tourism in
co-operation with the Ministry of Environment shall instruct
immediately institutions under their supervision in all provinces and
municipalities on the study of the above mentioned land use.


The National Committee for the
Urbanization and Construction shall instruct the Committee for the
Urbanization and Construction of Phnom Penh and the Sub-committee for
the Urbanization and Construction of provinces and municipalities on
the technological advances in the land use planning so that it can be
the "Etat Major" for provincial and municipal governors to prepare
plans for the development of each province and municipality.


The Ministry of Interior, the
Ministry of Agriculture, Forestry and Fisheries, the Ministry Public
Works and Transports, the Ministry of Industry, Energy and Mines, the
Ministry of Tourism, the Ministry of Environment, other relevant
ministries and institutions, city halls and provincial governor’s
offices shall implement this circular and submit 4 copies of their
plans to the Ministry of Interior prior to sending to the National
Committee for Urbanization and Construction for its approval by the
Royal Government before the end of July, 1996.
